“College sports, as we know it, is facing a countdown clock running out of time.

The House v. NCAA class-action lawsuit is slated to begin trial on Jan. 27, 2025, less than 300 days away. Simply put, if the NCAA and Power Four conferences lose, they could owe thousands of athletes some $4.2 billion in retroactive NIL pay and broadcast revenue. And NIL rule changes could take hold that would permit schools and conferences to pay NIL dollars to athletes for any reason, including athletic performance.

Every administrator in college athletics is thinking about this lawsuit on a nearly daily basis.”

» Background. “As Yahoo Sports reported Thursday, and On3 later obtained, a new piece of meeting material has been floated by the NCAA’s NIL working group to the Division I Council that would permit schools to provide “assistance and services” to their athletes in pursuit of NIL opportunities, including facilitating deals with third parties. It’s a refined version of NCAA President Charlie Baker’s Project D-I proposal, which was first floated in December. Notably, the new material does not include language that would permit schools to directly pay NIL to athletes.”

» Court Awareness. “The list of state laws pushing back against the NCAA’s power to govern continues to pile up. The House and Senate in Virginia passed legislation that allows institutions to pay athletes compensation in the form of NIL. This could begin as soon as Nov. 15, 2024, before House v. NCAA even begins. The bill would prevent the NCAA and conferences from preventing institutions from compensating college athletes for their NIL.”

» Be Smart. “U.S. District Judge Claudia Wilken will oversee House v. NCAA. She’s the same judge who ruled against the NCAA in O’Bannon and Alston – the landmark cases that opened the door for NIL in college sports – at the trial court level. Clearly, she is not averse to ruling that NCAA compensation rules violate antitrust law.”

2. Staley: Transgender Athletes Should Be Allowed to Play

“South Carolina women's basketball coach Dawn Staley said Saturday that she believes transgender athletes should be allowed to compete in women’s sports.

Staley was asked at the news conference the day before her unbeaten Gamecocks play Iowa for the national championship for her opinion on the issue.

“I’m of the opinion that if you’re a woman, you should play,” Staley said. “If you consider yourself a woman and you want to play sports, or vice versa, you should be able to play.”

» Court Awareness. “The topic has become a hot-button issue among conservative groups and others who believe transgender athletes should not be allowed to compete on girls’ and women’s sports teams. Last month, more than a dozen current and former women’s college athletes filed a federal lawsuit against the NCAA, accusing the college sports governing body of violating their rights by allowing transgender women to compete in women’s sports.”

» What’s Next. “In 2022, the NCAA revised its policies on transgender athlete participation in what it called an attempt to align with national sports governing bodies. The third phase of the revised policy adds national and international sports governing body standards to the NCAA’s rules and is scheduled to be implemented Aug. 1.”

» 🏃  Track and Field. “The U.S. Track & Field and Cross Country Coaches Association announced six inductees into the NCAA Division III Athlete Hall of Fame - Mary Proulx (Keene State), Melissa Norville (Ithaca), Ryan Kleimenhagen (UW-Platteville), Brad Parris (McMurry), Ted McMillan (Augustana), and Keelin Godsey (Bates).

» 🥎  Softball. Cedar Crest RHP Corinne Mundy tossed a no-hitter as the Falcons blanked Clarks Summit, 5-0. She walked two and fanned three in earning the squad’s first win of the season.

» 🗞️ News. “University of Wisconsin Oshkosh faculty voted no-confidence in their chancellor, Andrew Leavitt, sending a symbolic message of disapproval during a difficult budget year.”

» 🗞️  News. “Manhattanville College became Manhattanville University on Wednesday, a sign to the public of a broader range of academic offerings.”
